NPA Secures Life Sentence for Man Convicted of Raping 15-Year-Old Girl
The National Prosecuting Authority (NPA) remains resolute in its fight against gender-based violence and sexual offences, particularly those involving children and vulnerable victims. Through thorough investigations, strong evidence-led prosecutions, and victim-centred approaches, the NPA continues to ensure that perpetrators of these heinous crimes are held accountable and receive appropriate sentences that reflect the gravity of their actions.
To this end, the NPA welcomes the term of life imprisonment handed down by the Durban Regional Court to a 29-year-old man, convicted of raping a 15-year-old girl in January 2024 in the Durban central area. The accused lived next door to the complainant and her mother in a building in Durban. At some point prior to the incident, the accused went away and gave the complainant’s mother his room keys to keep, in case of emergencies. When he returned on 14 January 2024, he fetched his keys and went to his room. The complainant’s mother then told the complainant to dish some food for the accused and drop it off at his room. When the complainant entered the accused’s room, he accosted her and pulled her hands behind her back. He then proceeded to rape her. Even though the complainant tried to free herself, the accused pinned her under him to prevent her from escaping. The complainant managed to escape when her mother entered the room.
Thereafter, the complainant’s mother approached the complainant and the complainant divulged that she had been raped by the accused. The accused fled the building but later handed himself over to the authorities, with his attorney. The victim received medical attention at a nearby hospital.
Adv. Cheryl Pillay led the state’s case, presenting evidence that included the testimonies of the complainant, her mother (the first report and eyewitness), and the doctor who examined the complainant. The J88 medical report detailing the complainant’s injuries further strengthened the case.
In aggravation of sentence, Victim Impact Statements compiled by the complainant and her mother, and facilitated by Court Preparation Officer Nondumiso Nyembe, were submitted. The complainant described becoming withdrawn, emotional, and suffering a decline in her school performance. Her mother highlighted the emotional trauma the victim continues to endure. The complainant is receiving ongoing counselling. In addition to the life sentence, the court declared the accused unfit to possess a firearm, unsuitable to work with children, and ordered that his name be entered into the National Register for Sex Offenders.
The NPA hopes that this sentence will serve as a strong deterrent to would-be perpetrators. Together with our partners in the Justice, Crime Prevention and Security Cluster, the NPA remains committed to intensifying efforts to combat the scourge of sexual offences.
