Brown Mogotsi denied bail, legal team to appeal ruling




The Johannesburg Magistrate’s Court has denied bail to Brown Mogotsi, citing concerns over his lack of a fixed and verifiable residential address, which the State argued makes it difficult for authorities to trace him if released.

Brown Mogotsi, a North West businessman and alleged political fixer, was arrested on May 15, 2026, following his testimony at the Madlanga Commission, and faces charges including unlawful possession of a firearm and ammunition, discharging a firearm in a built-up area, perjury, and defeating the ends of justice for allegedly staging a hit on his life in November 2025

His bail application was initially scheduled for May 18, 2026, but was postponed because the state needed additional time to verify his residential address in Mmabatho, North West, which is outside Gauteng, creating logistical challenges for investigators

The court rescheduled the bail hearing to May 25, 2026, but as of that date, no final decision on bail had been reported, meaning Mogotsi remains behind bars

The prosecution indicated that it did not intend to oppose bail but emphasized that a final determination should only occur after the address verification process was complete His legal team opposed the extended postponement, arguing that the verification could have been completed earlier and that further detention before a formal bail hearing was unfair.

Brown Mogotsi is still in custody. The case has been postponed to 12 June 2026 where his legal team is set to appeal the ruling.
