STEPFATHER SENTENCED TO LIFE IMPRISONMENT FOR RAPING HIS STEPDAUGHTER
The National Prosecuting Authority (NPA) welcomes the sentence of life imprisonment handed down by the Ekangala Magistrates’ Court to a 37-year-old man who cannot be named to protect the identity of the child victim. This is after the man was convicted of rape of his 13-year-old stepdaughter. The court ordered that his name be added to the Register of Sexual Offenders and declared him unfit to possess a firearm.
On the afternoon of 24 December 2023, the man took his stepdaughter to his friends’ place of residence, which was not far from his own in Ekangala. On arrival, the man requested his friend to buy alcohol while he stayed behind with the child. While waiting for the friend to return the child fell asleep on the couch and the man proceeded to rape her. The victim woke up, pushed him off and ran to their place of residence where she told her grandmother about what had happened. The grandmother opened a case against the man and after investigations by the police, he was arrested on 30 December 2023 and has been in custody since the NPA successfully opposed his release on bail.
In court, the man pleaded not guilty to the charge preferred against him and said the mother of the victim is using the child to get to him. However, state Prosecutor Jonas Mahlangu presented compelling evidence, including the testimony of the victim, which proved the accused’s guilt beyond a reasonable doubt.
During sentence proceedings, the man, through his legal representative requested the court to deviate from imposing the prescribed minimum sentence of life imprisonment and said that he is a first-time offender, he is employed and has three children. However, Mahlangu argued that the man was in a position of trust and instead of protecting the victim, he abused her. Furthermore, he said that even after the man was convicted of a serious offence he did not show any remorse for his actions.
In handing down judgment, Magistrate Kalile Bosch agreed with the state that the man showed no remorse and that he is convicted of a serious offence that is prevalent in the court’s jurisdiction. Therefore, the Magistrate found no substantial and compelling circumstances to deviate from imposing the prescribed minimum sentence of life imprisonment.
