Economic Freedom Fighters (EFF) leader Julius Malema has been sentenced to five years’ direct imprisonment by the East London Magistrates’ Court for discharging a firearm during a political rally in 2018.
Malema is expected to start his jail sentence on 16 April 2026.
The court ruling that the sentences on counts two through five will run concurrently with count one.
Overview of Charges
Firearms Control Act Violations: Malema was charged with several offenses under the Firearms Control Act, including:
Unlawful possession of a firearm.
Unlawful possession of ammunition.
Discharging a firearm in a built-up area or public place.
Reckless endangerment of people or property.
The charges stem from an incident during the EFF's fifth anniversary celebration at the Sisa Dukashe Stadium in Mdantsane, Eastern Cape, on July 28, 2018.
Malema was seen firing a rifle into the air in front of a large crowd, which led to public outcry and legal action initiated by the lobby group AfriForum.
His former bodyguard, Adriaan Snyman, who was co-accused, was acquitted of all charges.
The Guilty verdict sentencing will determine his political future.
In South Africa, a convicted person is generally not eligible to run for parliament if they have been sentenced to more than 12 months in prison without the option of a fine.
This prohibition is outlined in section 47 of the Constitution and is designed to maintain the integrity of the democratic process. However, the eligibility to stand for election is not permanently barred; it ends five years after the completion of the sentence.
This means that once Mr Malema completes his sentences, he may be eligible to run for parliament after the five-year period has passed.
